In this article we show that the Deontic Transfer Principle is vulnerable to counterexamples, and that the same is true of a range of closely related principles. In this article, I respond to John Betz who has recently rejected claims that I have made about Erich Przywara’s anti- Semitism and his relationship to Nazi era ideology. Although I admire much of Przywara’s theology and have great sympathy for the teaching about the analogy of being, in this article I address some of the problems of Przywara’s work. I address literature from Przywara on the Jews where he talks about the essence of “the Jew” as “restless” and “revolutionary,” (...) and where he brings up the “wandering Jew” theme or claims Judaism is an “insolent disturber” of the “folkdom.” Przywara’s rejection of “Jewish messianism” and his claims about the “basic tension of the Jew” are also addressed. I analyze his conception of the essence of “the Jew” as, among other things, a “rising will of destruction” and his claim that “Christianity” ultimately becomes the “enemy” of Judaism. Beyond these things, Przywara’s desire to “overcome” Judaism with the right “weapons” is addressed. I also draw attention to his rejection of “Jewish capitalism” and his justification of “the hatred towards the Jews in world history.” In addition to this, his use of ideologically charged Nazi terminology, such as “host-peoples,” and his support of Catholic integralism in Nazi Germany are addressed. Furthermore, Przywara’s remarks on “the positive sense” of the German “movements” in the 1930s are presented. I also show that Przywara”s work was praised by a leading representative and ideologue of National Socialism. With this, I address the internal Nazi correspondences on the very influential German Catholic Jesuit journal titled Stimmen der Zeit. (shrink)

Theologians and Old Testament scholars have been at odds with respect to the best interpretation of the imago Dei. Theologians have preferred substantialistic (e.g., image as soul or mind) or relational interpretations (e.g., image as relational personhood) and Old Testament scholars have preferred functional interpretations (e.g., image as kingly dominion). The disagreements revolve around a number of exegetical questions. How do we best read Genesis 1 in its literary, historical, and cultural contexts? How should it be read theologically? How should (...) we read Genesis 1 as a canonical text? This book charts a path through these disagreements by offering a dogmatically coherent and exegetically sound canonical interpretation of the image of God. Peterson argues that the fundamental claim of Genesis 1:26-28 is that humanity is created to image God actively in the world. "Made in the image of God" is an identity claim. As such, it tells us about humanity's relationship with God and the rest of creation, what humanity does in the world, and what humanity is to become. Understanding the imago Dei as human identity has the further advantage of illuminating humanity's ontology. Canonically, knowledge of the contours and purpose of human existence develops alongside God's self-revelation. Tracing this development, Peterson demonstrates the coherence of the OT and NT texts that refer to the image of God. In the NT, Jesus Christ is understood as the realization of God's image in the world and therefore the fulfillment of the description of humanity's identity in Genesis 1. In addition to its specific focus on resolving interdisciplinary tensions for Christian interpretation of the imago Dei, the argument of the book has important implications for ethics, the doctrine of sin, and the doctrine of revelation. Puritans had big stories to tell, and they cast themselves big parts to play in those stories. The fervent English Protestants who believed that the Elizabethan Church urgently needed further reformation, and the self-selecting band among them who went on to colonize New England, were sure that they could re-create the churches of the apostolic age, and eliminate centuries’ worth of Romish accretions. By instituting scriptural forms of worship, these purified churches might have a beneficial influence on the state as (...) well, and bring about the rule of the godly. If a purified English church and state could inaugurate reformation across all of Christendom, spread the gospel to infidels around the globe, and usher in the millennium, then all the better. In 1641, an anonymous tract called A Glimpse of Sions Glory announced that the new puritan-controlled Parliament would bring on “Babylon's destruction... The work of the day [is] to give God no rest till he sets up Jerusalem in the praise of the whole world.” The leading minister of colonial Boston at the time, John Cotton, predicted that as soon as 1655, as Michael Winship summarizes Cotton: the states and Christian princes of Europe, under irresistible supernatural influence, would have instituted congregationalism [Massachusetts’ form of church polity] and overthrown Antichrist and Muslim Turkey. The example of their churches’ pure Christianity would have brought about the conversion of Jews and pagans across the globe. Thereafter, the churches of Christ would enjoy the millennium's thousand years of peace before the climactic battle with Gog and Magog at the end of time. Those are big stories. (shrink)

In recent years, third-party forgiveness has received renewed attention, much of it negative. While a few have undertaken important attempts to defend or expound accounts of third-party forgiveness, many suspect that it is incoherent, vicious, or both. If true, this would be bad news for Christians, for Christians rely on notions of third-party forgiveness for their accounts of salvation and pastoral authority. I think there is reason to think that some notions of third-party forgiveness can overcome the critics’ worries. In (...) what follows, I argue that third-party forgiveness is more common, coherent, salutary, and diverse in species than many critics suppose. After considering key objections to third-party forgiveness, I offer a constructive account of it that makes sense of these objections while also defending the underlying concept and act. What emerges from this defense is a newfound appreciation for the diverse species of third-party forgiveness. Still, some of these species are more intelligible and safeguarded from declension than others, and I conclude by examining the limits of third-party forgiveness by considering its most contentious species. Recent commentary on Foundations of Christian Faith has described Rahner as conflating “atonement” generally with penal substitutionary theories of a changing God, as ruling out the redemptive significance of Christ’s death, and as denigrating the normativity of Scripture in order to do so. This book explores the moral, social, and spiritual dimensions of ecological restoration. Gretel Van Wieren, a religion scholar, builds on the work of both critics and advocates of restoration to develop a balanced and well-informed approach to a controversial topic in environmental ethics. Ultimately she finds much value in restoration, as much for its ability to help build human community as for its contributions to ecological well-being. Restoration, she summarizes, is “the attempt to heal and make the human relationship to (...) nature whole” (2).While she holds a generally positive view of restoration, Van Wieren consistently faces the ambivalence inherent in human efforts to recreate wild habitats. Restorationists are faced, as she explains, with “the simultaneous realities that they are in some sense making up nature as they go… and that natural processes are in some sense other than and beyond the human mind” (20). This concise, well-structured survey examines the problem of evil in the context of the philosophy of religion. One of the core topics in that field, the problem of evil is an enduring challenge that Western philosophers have pondered for almost two thousand years. The main problem of evil consists in reconciling belief in a just and loving God with the evil and suffering in the world. Michael Peterson frames this issue by working through questions such as the following: What (...) is the relation of rational belief to religious faith? What different conceptual moves are possible on either side of the issue? What responses have important thinkers advanced and which seem most promising? Is it possible to maintain religious commitment in light of evil? Peterson relies on the helpful distinction between moral and natural evil to clarify our understanding of the different aspects of the problem as well as avenues for response.The overall format of the text rests on classifying various types of argument from evil: the logical, the probabilistic, the evidential, and the existential arguments. Each type of argument has its own strategy which both theists and nontheists must recognize and develop. Giving both theistic and nontheistic perspectives fair representation, the text works through the issues of whether evil shows theistic belief to be inconsistent, improbable, discredited by the evidence, or threatened by personal crisis.Peterson explains how defensive strategies are particularly geared for responding to the logical and probabilistic arguments from evil while theodicy is an appropriate response to the evidential argument. Theodicy has traditionally been understood as the attempt to justify belief in a God who is all-powerful and all-good in light of evil. The text discusses the theodicies of Augustine, Leibniz, Hick, and Whitehead as enlightening examples of theodicy. This discussion allows Peterson to identify and evaluate a rather dominant theme in most theodicies: that evil can be justified by designating a greater good. In the end, Peterson even explores how certain types of theodicy, based on specifically Christian renditions of theism, might provide a basis for addressing the existential problem of evil. In the 19th and (...) 20th century Balthasar sees a dramatic deterioration of religious and intellectual sensibilities and an alienation from these earlier foundations. Balthasar presents “the Jewish” as an adversary of these foundations. This article retrieves Freud’s Paul as a forgotten predecessor and untapped critic of the “return to Paul” in contemporary political theology and continental philosophy. Given that Sigmund Freud published Moses and Monotheism in 1939 having barely escaped from Vienna, the text’s reception has justly been dominated by the question of Freud’s identification with Moses and the relationship between psychoanalysis and Judaism. However, I argue that this narrow focus has obscured the more fundamental problem of the connection between religion and Freud’s (...) enigmatic notion of “historical truth,” which he works out not through Moses but through Saint Paul. To do so, I first show how Freud’s genealogy of monotheism is modeled on the pathogenesis of hysterical symptoms. I then trace how Freud deepens his investigation into the etiology of symptom-formation until he arrives at the notion of historical truth and the archaic heritage that transmits it. Lastly, I demonstrate that Freud presents himself less as a Pauline figure than he does Paul as a proto-analyst. Through this staging, I contend that Freud parochializes the claims of Christianity as symptomatic of a more archaic historical truth that psychoanalysis alone is able to access. Freud’s Paul demonstrates that it is not a question of whether but how ostensibly modern secular discourses inherit the theological traditions in which they are imbedded. Reading Freud as a philosopher of religion ultimately offers an indictment of any philosophy or emancipatory politics naively modeled on theological universalism. (shrink)

The roots of much of Western medicine lie in the Christian monastic tradition and its commitment to nonstigmatizing compassionate care throughout the life cycle and to the ideal of empathic personal connection between physicians, patients, and the communities and relationships in which both of these are embedded. In the modern West, these Christianly informed aspects of medicine are increasingly being undercut as medical care becomes ever more specialized, technologized, and depersonalized. At the same time, there exist a variety of (...) efforts to counter these tendencies and to foster a practice of medicine that is more sensitive to the personal, relational, familial, and narrative dimensions of health, illness, and medical care. There are, in particular, considerable numbers of physicians, psychologists, and psychotherapists working at the intersections of biomedical and psychosocial care, of care for individuals and care for families, and of the body and the mind. Given the natural affinity that Christian bioethicists might be expected to have to communitarian, narrative, and family-oriented approaches to health care, it is thus remarkable that there appears to be no work of Christian bioethics that interacts in any discernible way with this psychotherapeutic literature concerning health, illness, families, and the mind-body interface. Instead, Christian bioethicists appear to endorse a narrowly reductionistic biomedical view of health and illness while either ignoring the psychosocial, integrative, and collaborative literature, or actively blaming and shaming those pastors or lay Christians who might have anything to do with psychotherapy or psychosocial care. This is unbecoming and unhelpful. In the fragmented, complex, and potentially dehumanizing world that is modern medical care, those who would think Christianly about the care of the sick cannot afford to despise psychology and psychosocial care. On the contrary, the church needs psychotherapy. In this article, I will thus consider, first, what the state of the conversation is where Christian bioethics and psychosocial and psychotherapeutic care are concerned. I will then turn to some of the principal landmarks in the professional literature concerning psychotherapeutic work with the sick, the disabled, the dying, and the bereaved, particularly as these are considered in contexts that include families and lay and professional caregivers. I will then identify a few opportunities for practical and theological reflection that present themselves in this literature, and will conclude with a few comments on the substance and relationship of salvation and health. The practice of sending and receiving sexually explicit images via mobile phones has grown exponentially in recent years with the accessibility of cellular technology. This essay examines this practice, when conducted by teenagers, in light of a Christian feminist approach to justice. Without harmfully exhorting girls' sexual "purity", we must nevertheless develop a moral framework that challenges the practice of sexting while simultaneously empowering young women to claim primary control over their own sexual experience. The dual character of acclamations, religious and political, makes of acclamations a perfect place to explore theological-political transferences. Acclamations were central in ancient times in order to constitute a community and to show its acceptance, whether they took place in a republic while deciding in assemblies or during the accession of an emperor. The Christian-Church adopted this imperial ceremonial style with the introduction of imperial laudes into the Church and accommodated it to its own needs. Modern times recovered the (...) magic of acclamations in order to give space to the vox populi in the constitution of the political community. The aim of the present article is to explore the centrality of acclamations in religious and political life through three key texts: Kantorowicz’s Laudes regiae, Peterson’s Heis Theos and Schmitt’s Volksentscheid und Volksbegehren. These texts are interrelated and could be considered a particular case of a broad hidden dialogue between these three authors. The theological-political character and evolution of the practice of acclamations in the West coming from the East shows that the line that divided the sacred from the secular has been always far from fixed, and was instead subject to fluctuation, pressures from every side, and constant renegotiation. This book presents the first systematic typological analysis of applicatives across African, American Indian, and East Asian languages. It is also the first to address their functions in discourse, the derivation of their semantic and syntactic properties, and how and why they have changed over time.Applicative constructions are typically described as transitivizing because they allow an intransitive base verb to have a direct object. The term originates from the seventeenth-century missionary grammars of Uto-Aztecan languages. Constructions designated as prepositional, benefactive, and (...) instrumental may refer to the same or similar phenomena. Applicative constructions have been deployed in the development of a range of syntactic theories which have then often been used to explain their functions, usually within the context of Bantu languages. Dr Peterson provides a wealth of cross-linguistic information on discourse-functional, diachronic, and typological aspects of applicative constructions. He documents their unexpected synchronic variety and the diversity of diachronic sources about them. The COVID-19 pandemic has been devastating for people living with dementia (PLWD) and their caregivers. While prior research has documented these effects, it has not delved into their specific causes or how they are modified by contextual variation in caregiving circumstances.

Joseph Heath defends competitive markets and conceptualizes business ethics with reference to Pareto efficiency, which he takes to be the “implicit morality of the market.” His justification for markets is that they generate Pareto efficient outcomes, meaning that markets optimally satisfy consumer preferences. And, for Heath, business ethics is the set of normative constraints—regulation and beyond-compliance norms—needed to preserve that outcome. The present paper accepts Heath’s claim that the economic justification for markets is ethical, in that satisfying consumer preferences is (...) a good. But, contra Heath, the ethical consideration at work is a consequentialist one; and acknowledging this consequentialism exposes limitations of Heath’s “market failures” approach to business ethics. We suggest two limitations, and we expect many will accept our argument that Heath’s conception of business ethics is too narrow. The present paper outlines two broader implications. First, acknowledging that the justification for markets is ethical eliminates the apparent—and false—conflict between purportedly amoral economic activity on one hand and ethical considerations on the other; instead, business ethics is a matter of weighing the consequentialist ethical benefit of economic activity and markets against other moral arguments/other ethical considerations. Second, Heath restricts business ethics to the constraints needed to protect the market’s ability to efficiently satisfy consumer preferences, constraints he calls “efficiency imperatives”; this restriction supports the widespread tendency to think that all social problems are economic; and, a business ethics so-conceived diminishes the perceived importance of noneconomic values—this attitude is dangerous. Joseph Heath states that our paper “misinterpret[s]” and so misrepresents his account. The present Commentary corrects the record. Our paper (Cohen and Peterson 2019) outlined Heath’s account on his own terms; it explained that Heath distances himself from consequentialism. But then we argued that Heath is mistaken and so offered a repaired version of the market failures approach. Interpreting intentional intervention as part of human stewardship rather than as a wrongful interference with some divine (...) plan, he takes on the sticky questions, making critical distinctions, for example, between cure and enhancement or welcoming children as they come and making them “better.” Not neglecting future implications of current tinkering with human biology, even in such taboo areas as gamete selection, he contends that engineering a baby free of harmful genes (for example, Tay-Sachs or Down syndrome) not only makes that person better, but it also eliminates an ongoing burden to family, to society, and perhaps to future generations. Treading gingerly among the sacred cows of some Christian ethicists, he advocates the implanting of selected embryos free of unwanted genes; in his view, embryos are not yet persons.Peterson considers serious concerns such as eugenics projects and racial bias but offers standards to address them. He contends that intentionally increasing choices for our children is not only acceptable but also praiseworthy. What parents would not optimize the educational and social opportunities for their child, even without the child’s consent? Interventions should be safe, offer genuine improvement, increase the recipient’s capacity, and make the best use of limited resources. Peterson is not so naive that he does not recognize that technology does not always make us better. He recognizes, too, that his standards do not eliminate risk.Fair enough, but the issue of what “improvement” may mean to the individual as well as to the greater community remains somewhat ambiguous. Peterson suggests that broadening the decision making among a variety of professional and individual cohorts would help, but his argument is not totally persuasive. In sum, Peterson’s treatment falls short of offering a totally satisfying standard for determining which characteristics should be manipulated and which should be accepted. Does the deaf parents’ desire for their child to be deaf like them constitute an instance where intervention should not be attempted? Can the disparate cohorts he suggests as arbiters rise above their own biases? Does Christianity and its belief system offer answers? Readers—even readers who call themselves Christian—will likely be persuaded that genetic intervention is a good, and even compatible with their religious perspective. Nonetheless, they will harbor lingering doubts about how the questions can best be solved, who should solve them, and how Christian belief helps sort among the possibilities. In his closing comments Peterson appears to agree.The book is rich in research and in provocative ideas. It is an exciting book. It is a readable and enlightened contribution to the professional conversation on gene therapy. Peterson’s research is extensive, his argumentation balanced. His attempt to locate the question within the Christian tradition is laudable. Happily, Peterson eschews a creationist approach to world and human origins. Unhappily, his approach to the scriptural text is not always nuanced. His assertion that Jesus himself was different biologically from other human beings (132) seems a stretch. If one takes the passages of Jesus’s biological origins literally, as apparently does the author, what happens to the assertion that Jesus is like other human beings “in all things but sin”? And where did Jesus get the Y chromosomes? While he persuades the reader that genetic intervention is compatible with a Christian worldview, Peterson does not offer—at least in this reviewer’s view—an adequate criterion for navigating this new world of the possible.Dolores L. Steve Wilkens edits a conversation between four major approaches to contemporary ethics in the Christian tradition: virtue, divine command, natural law, and prophetic. This accessible introduction includes contributions by Brad Kallenberg, John Hare, Claire Peterson, and Peter Heltzel.

Nikolai Fedorovich Fedorov is one of the most original and as yet inadequately studied Russian thinkers. Neither a professional philosopher, nor a well-known scholar, nor a critical essayist, he led a kind of double existence while working as an ordinary civil servant, developing his original philosophy at his leisure in the hours free from his intensive daily work. Fedorov's life was one of selflessness and self-denial, not at all eventful outwardly. He graduated from the Gymnasium in Tambov and completed three (...) years of study in the Law Department of the Richelieu Lyceum in Odessa, after which he taught for a number of years in the Borovsk, Lipetsk, Podol'sk, and other regional schools. The quarter century he spent working in the Library of the Rumiantsev Museum in Moscow was the most stable period in Fedorov's life. Fedorov's ideas attracted the attention of outstanding cultural figures. F.M. Dostoevskii became acquainted with them in 1878 through Peterson, and on March 24 of that year he wrote: "I am essentially in full accord with these ideas. I read them as if they were my own." L.N. Tolstoy, who knew Fedorov personally, said, "I am proud to be living in the same times as such a man." V.S. Solov'ev, who also associated with Fedorov, wrote to him as follows in the mid-1880s: "Your ‘project’ is the human spirit's first advance along the path of Christ since the advent of Christianity. As for me, I can only acknowledge you as my teacher and spiritual father." A.M. Gorky was especially impressed by the activism in Fedorov's views. But none of this precludes the many and very essential divergences of these authors from Fedorov. One can find some links with his ideas in A.N. Belyi, V. Ia. Briusov, N.A. Zabolotskii, V.V. Maiakovskii, A.P. Platonov, M.M. Prishvin, I.L. Sel'vinskii, O.D. Forsh, and V.N. Khlebnikov. The artist B.N. Chekrygin drafted a large fresco entitled The Resurrection of the Dead [Voskreshenie mertvykh] and a philosophical work entitled The Synod of the Resurrecting Museum [Sobor voskreshaiushchego muzeia], both inspired by Fedorov's teachings. Chapter I. The Origin of Value. The popular impression is that value originates in utility, but certain well-k nown phenomena seem to contradict this. The duty of the value theorist is not to ignore either side, but to interpret the actual valuations of men in economic life: and the test of the theory is that his value is their value.

Slavoj Žižek is one of the most influential philosophers of our current age. His work as a whole largely draws from Platonic, Cartesian, Hegelian and Lacanian thought, and has been applied to the analysis of empirical sciences, political-economic theory, as well as contemporary spirituality and theology. Jordan Peterson is a well respected clinical psychologist and has recently become one of the most influential public intellectuals of our current age. His work as a whole largely draws from Christian, Nietzschean, (...) Jungian and Piagettian thought, and has been antagonistically situated in contemporary debates on the nature of gender identity, sexual expression, communist ideology, and the importance of responsibility for a meaningful life. During Peterson’s rise to global fame these two thinkers have often been symbolically positioned by those familiar with their work as figures in an oppositional determination : Žižek standing for the future of the progressive left and revolutionary communist values, and Peterson standing for the future of the conservative right and traditional patriarchal values. In this work it is argued that the difference internal to this antagonistic positioning can be put to a productive utility. Towards this end I first attempt to use Christianity, Postmodernism and Psychoanalysis as thematic structures to focus on their core differences. Secondly, I attempt to summarize the major points of agreement that emerged from their public debate/dialogue/discussion. These two goals are established to demonstrate the importance of higher order dialogue capable of reconciling opposed figures of consciousness. Such reconciliation would not represent a synthesis to erase all differences, but rather a reconciliation that would open new spaces of productive discourse capable of approaching the nature of psychology and society. Giorgio Agamben's The Kingdom and the Glory opens by intervening in a debate between the jurist Carl Schmitt and the theologian Erik Peterson. Peterson's “Monotheism as a Political Problem” undermined Schmitt's thesis that the modern concept of sovereignty derives from Christian theology by arguing that divine monarchy is a Judaic and Greek idea that was liquidated by the doctrine of the Trinity. Agamben, by contrast, argues that the Trinity preserves and transforms the model of divine monarchy by (...) casting God as singular in his being and multiple in his management of the world. I argue that this critique of Peterson in fact builds upon the “Monotheism” essay, which shows how political theologians inherited and rearticulated conceptual problems derived from Aristotle's Metaphysics, and is driven by Agamben's concern with the impact of Aristotle's thought on ontology and politics. This textbook examines the extent to which moral values play a role as productive forces for the economy, and explores the effect of ethical and unethical Behavior on the economy. It shows how ethics improves productivity in the economy, and provides specific ethics tools for practical application for students and managers. Stemming from an overall interdisciplinary approach, and combining recent research results from sciences such as economics, business administration, Behavioral economics, philosophy, psychology and sociology, this textbook fills a gap in (...) the literature on ethics in business. The book begins with the foundations of business ethics by defining business ethics, delineating its objectives, and discussing the importance of business ethics for business, the economy and society. Next, it presents the ethical evaluation approaches to enable the reader to evaluate economic Behavior ethically. It then explores ‘man in business’, and deals with such issues as Behavior, motivation, ethical orientation, and the presence or absence of a sense of justice. Following this is a discussion of the rules of the market and of questions such as: Does the market economy promote ethical Behavior or is there a conflict of goals between ethics and market economy? Do companies have a social responsibility? The book concludes with an analysis of the importance of ethics for productivity in the enterprise and in the economy, and presents ethics tools as the instruments with which management can promote ethical Behavior of their employees. Following a textbook structure, the book first derives knowledge from scientific studies that is relevant for students, and then summarizes the results. It explains ethical assessment approaches, and then gives an ethical assessment of economic Behavior using case studies. The paper describes an innovative structured workshop methodology in garden-based-learning called “Nature in Your Face” aimed at provoking a change in citizens behavior and engagement as a consequence of the emotional activation in response to disruptive artistic messages. The methodology challenges the assumption that the change needed to meet the carbon targets can be reached with incremental, non-invasive behavior engineering techniques such as nudging or gamification. Instead, it explores the potential of disruptive communication to push citizens out of their comfort (...) zones and into creative modes of re-creating futures. This is done by confronting us with consequences of consumption by means of art and eco-visualizations. The aim being to achieve awareness, mental flexibility, and spurring debate. Thus, we invite them to react – and act upon these reactions by communicating their feelings or thoughts. This is used as an entrance point for broader and/or deeper engagement in a structured three-step methodology; Framing: A disruptive element is introduced into the local environment. This triggers an emotional reaction, which then is taken up in a process of framing the problem and working with solutions. Twisting: in a guided process, the initial energy from the emotional confrontation is twisted into a creative exploration of innovative solutions, from the perspective of the children. Using: The last stage is using the developed solutions in the local social system. The methodology is being applied in cooperation with a primary school, and is iteratively adjusted and evaluated in a formative, action-research based approach scenario. NiYF is to stimulate societal engagement through deliberately confronting stakeholders with unexpected and potentially upsetting appearances of nature, climate effects, or carbon-neutral lifestyle scenarios. We have verified the practical usefulness and potential of the methodology and found that NiYF triggers societal engagement and transition, negotiating responsibilities and unlocking action potentials. We also found that eco-anxiety, denial, self-efficacy and cognitive dissonance form children’s understanding of plastic. The project marks a paradigm shift from creating knowledge to using knowledge to create action, and a focus on learning from evaluating and adapting the approach in the field. (shrink)

Recent studies :98–144, 2002; Weismann, J Bus Ethics 88:615–66, 2009) revealed that in the first 28 years of its existence, the Foreign Corrupt Practices Act was not enforced by the federal government. The Weismann study further concluded that the FCPA, designed by Congress as a self-regulatory model of corporate governance, failed to achieve the regulatory goal of deterring global bribery by U.S. companies. The current article addresses the reasons that the FCPA remains an ineffective measure to control bribery as a (...) global market entry strategy despite the highly publicized 2006 Department of Justice initiative to increase prosecutions and tighten enforcement efforts. The failure arises out of both the increased use of informal dispositions of case prosecutions,, which has made “getting caught” merely an increased “cost of doing business” and the failure to close the regulatory gaps in the statute that permit violators to slip through the enforcement net. The article updates and compiles the case prosecution data for every reported case prosecuted between 1977 and 2011. That data are then compared to the results of a 2010 integrity risk survey performed by Deloitte Financial Advisory Services and Forbes which reveal a widely held global business perception that compliance and integrity risks appear to be rising sharply and that the FCPA is ineffective in deterring bribery and corruption in foreign markets. The article aims to serve as a predictive tool for policy makers and business professionals in assessing risk in the global markets, particularly as commerce intensifies in the BRIC countries, notable for bribery and corruption.
